These Terms govern your use of SpreadTheArt, a marketplace where guests purchase archival prints of original artworks they encounter installed in hospitality and residential spaces. By using the platform, creating an account, or placing an order, you agree to these Terms.
1. Who we are and what SpreadTheArt is
SpreadTheArt (“SpreadTheArt,” “we,” “us,” or “the platform”) operates an online marketplace for made-to-order fine-art prints. Independent artists submit original works for representation. Hosts (property managers and their organizations) install those originals on the walls of properties they manage and place a QR label beside each work. When a guest scans that label, they can view the work, learn about the artist, and order an archival print.
SpreadTheArt acts as the platform and merchant of record for these transactions: we host the catalog, process payments, and coordinate production and fulfillment of prints. We are not the creator of the artworks, and the physical original always remains installed and is not for sale through the platform.
2. Roles and relationships
The platform serves several distinct roles, and these Terms apply to all of them:
- Artists retain ownership of their artworks and grant SpreadTheArt a license to reproduce and sell prints as described in Section 7. Artists earn a share of each print sale.
- Hosts and property managers curate which works appear in the spaces they manage and earn a commission on prints sold through their placements.
- Guests browse works and purchase prints. Guests may check out without creating an account.
- SpreadTheArt facilitates discovery, payment, and fulfillment, and distributes proceeds among the parties above.
SpreadTheArt is an independent contractor to artists and hosts. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship beyond the limited marketplace role described here.
3. Eligibility and accounts
You must be at least 18 years old and able to form a binding contract to sell on, or purchase through, the platform. Artist and host accounts require registration; you are responsible for the accuracy of your account information and for keeping your credentials secure. You are responsible for all activity that occurs under your account.
We may suspend or terminate accounts that violate these Terms, that we are required to remove by law, or that create risk for the platform or its users.
4. Orders and made-to-order prints
Every print sold through SpreadTheArt is made to order: nothing is produced until you place an order, and each print is produced specifically for you. Placing an order is an offer to purchase. Your order is accepted when we confirm it and submit it for production; until that point we may decline or cancel it (for example, for pricing errors, suspected fraud, or unavailability), in which case you will not be charged or will be refunded.
Prints are reproductions. Colors, framing, and finish may vary slightly from what appears on your screen due to monitor differences and the nature of physical production. Sizes and materials are as described on the product page at the time of purchase.
5. Pricing, taxes, and payment
Prices are shown at checkout in the listed currency and may include separately itemized shipping and estimated tax. Payments are processed by our payment provider, Stripe; by paying you also agree to Stripe’s applicable terms. We do not store your full card details — they are handled by Stripe. The total presented before you confirm is the amount authorized for your purchase.
Taxes are estimated at checkout and finalized based on your shipping destination and applicable law.
6. Fulfillment and shipping
Prints are produced and shipped by our fulfillment partner, Printful. To produce and deliver your order, we share the information necessary for fulfillment — including your shipping name, address, and the item ordered — with Printful. Estimated production and delivery times shown at checkout or in your confirmation are estimates, not guarantees, and may be affected by carrier delays or events outside our control. Risk of loss passes on delivery to the carrier; see our Refund & Returns Policy for damaged or lost shipments.
7. Cancellations, refunds, and returns
Because prints are made to order, cancellation and refund rights are limited and are described in full in our Refund & Returns Policy, which is incorporated into these Terms. In short: you may cancel an order for a full refund only before it is submitted for production, and we replace or refund items that arrive damaged, defective, or misprinted.
8. Artist content and licensing
Artists represent that they own or control all rights in the works they submit and that reproducing those works as prints does not infringe anyone else’s rights. By submitting a work, an artist grants SpreadTheArt a non-exclusive, worldwide license to display the work in the catalog and to reproduce, produce, market, and sell prints of it through the platform for as long as the work is listed, plus a reasonable period to complete pending orders. Artists retain copyright and may remove works from future sale on notice, subject to orders already in progress.
Artist proceeds, host commissions, and platform fees are governed by the rates disclosed in-product at the time of sale and any separate agreement between the parties. Payouts are made through our payment provider.
9. Host placements and commissions
Hosts are responsible for the placements they create, for having the right to install originals and QR labels in the spaces they manage, and for ensuring their placements are accurate. Hosts earn the commission disclosed in-product on prints sold through their placements. Hosts may pause or remove placements; doing so stops new sales from those placements but does not affect orders already completed.
10. Acceptable use
You agree not to:
- Upload, sell, or place artwork you do not have the rights to, or content that is unlawful, infringing, defamatory, or obscene;
- Use the platform to defraud, launder money, or process payments you are not authorized to make;
- Interfere with, probe, or attempt to gain unauthorized access to the platform, its data, or other users’ accounts;
- Scrape, resell, or misuse catalog content, guest data, or QR labels outside the intended purchase flow;
- Misrepresent an artwork’s origin, an artist’s identity, or your authority to place works.
We may remove content and suspend access for conduct that violates this section.
11. Intellectual property
Artworks and prints remain the intellectual property of their respective artists. The SpreadTheArt name, platform, software, and branding are our property or that of our licensors. Purchasing a print gives you ownership of that physical print for personal, non-commercial use; it does not transfer copyright or any right to reproduce the work.
12. Disclaimers
The platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the platform will be uninterrupted or error-free.
13. Limitation of liability
To the fullest extent permitted by law, SpreadTheArt and its artists, hosts, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising out of or related to your use of the platform.

14. Indemnification
You agree to indemnify and hold harmless SpreadTheArt and its affiliates from claims and expenses arising out of your breach of these Terms, your content, or your misuse of the platform. Artists and hosts additionally indemnify us against claims that their works or placements infringe third-party rights.
15. Governing law and disputes

16. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Continued use of the platform after changes take effect constitutes acceptance of the updated Terms.
